Contest Rules


ELIGIBILITY – Accent Inns – “ Duck Trails” (“the Contest”) is sponsored by Accent Inns (“the Sponsor”). The Contest is only open to residents of British Columbia who are eighteen (18) years of age (as of July 15, 2016) or older. Participant must be a member of Instagram ( (the “Website”) in order to participate and win any prize. Facebook, Inc. is not a sponsor of the Contest and does not endorse or otherwise have anything to do with the Contest. Employees, officers and directors of Sponsor, including retailers within Accent Inns, and their respective employees, officers, directors, subsidiaries, affiliates, advertising and promotional agencies, and their immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such employee, officer and director, are not eligible to enter.

ENTRY/SUBMISSION PERIOD - The Contest entry/submission period (all times are Pacific Standard Time) is open from 5:00 pm on July 15, 2016 until 12:00 pm on August 15, 2016 (“the Entry Period”). All entries must be received during this Entry Period to be eligible to win a prize. Proof of submission is not deemed to be proof of receipt of the entry.


You can enter the Contest on Instagram Anyone can enter the contest by doing the following the steps below:

  1. Follow Accent Inns on Instagram
  2. Post a Rubber Duck photo using the hashtag #AccentDuckTrails
  3. Encourage people to vote for your photo

Limit of one Entry per person, per day during the Contest Period. For the purposes of this Contest, a day is defined as the twenty-four hour period between 12:00:00 a.m. PT to 11:59:59 p.m. PT on the same calendar day. For greater certainty, you can only use one (1) email address to enter, or otherwise participate in, the Contest. If it is discovered that you have attempted to: (i) obtain more than one (1) Entry per person/email address per day of the Contest Period; or (ii) use more than one (1) email address to enter, or otherwise participate in, the Contest; then (in the sole and absolute discretion of the Sponsor) you may be disqualified from the Contest and all of your Entries are subject to disqualification by the Sponsor. Your Entry will be rejected if (in the sole and absolute discretion of the Sponsor) the entry form is not fully completed and submitted during the Contest Period. Use of any automated, script, macro, robotic or other program(s) to enter or otherwise participate in this Contest is prohibited and is grounds for disqualification by the Sponsor. By participating in the Contest, you agree to be bound to these Contest rules and regulations (the “Rules”) and to the terms and conditions and privacy statements posted on Accent Inns’ Facebook Contest page. All Entries are subject to verification. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s).


On August 16, 2016 at approximately 1:00 p.m. PT in Victoria, British Columbia, a random draw will be conducted from all of the eligible Entries received throughout the Contest Period to select a winner. The odds of winning a Prize will depend on the number of eligible Entries received during the Contest Period.


A representative of the Sponsor will notify the potential winners immediately after the draw via Instagram messenger. Each potential winner must comply with all terms and conditions of these official Rules. Winning is contingent on meeting all requirements. Each potential winner will be given 48 hours from the first time/day of attempted notification to respond to Sponsor via e-mail and/or phone call, in order to claim his/her prize. If the potential winner has not responded to Sponsor within the specified 48-hour period, the potential winner will be disqualified and an alternate will be selected from the remaining entries. If a selected entrant is found to be ineligible, he/she will be disqualified and an alternate winner will be selected, however no potential winner will be selected after August 30, 2016.


There is one (1) prize available to be won. The prize consists of a two (2) night stay at any Accent Inn and $250 cash (for duck feed). The prize must be used by May 1, 2017.


The Sponsor reserves the right, in its sole direction, to terminate, modify or suspend the Contest if, in the Sponsor’s sole opinion, there is any suspected or actual evidence of tampering with any part of the Contest, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties, acts of God or failures or any other factor beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest. The Sponsor is not responsible for any changes or unavailability of the Facebook service that may interfere with the Contest (including any limitations, any restrictions, or any conditions on Sponsor’s ability to use the Service for the Contest as set forth herein that are not acceptable to Sponsor) or ability of a participant to timely enter, receive notices or communicate with the Sponsor, in which case the Sponsor, in its sole discretion, may terminate the Contest. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or to be acting in violation of these Rules of Contest or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Rules of Contest shall not constitute a waiver of that provision or any other provision of these Rules of Contest.


By entering the Contest, each participant (and if a participant is a minor, his/her parent or legal guardian) irrevocably releases, in perpetuity, and holds harmless the Sponsor and their respective parents, subsidiaries, affiliates, agents, and all of the respective employees, directors, and agents of the foregoing from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from participant’s participation and/or entry in the Contest and/or participant’s award, receipt or use of any prize awarded in the Contest.


Except where prohibited by law, participation in the Contest constitutes participant’s consent to the Sponsor’s (and its designees’, successors’ and assigns’) use of participant’s name, biography, likeness, voice, photographs, photo, opinions, statements, hometown, province and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, notice or consent.


The Sponsor is not responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete, or misdirected entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service (including, without limitation, the Facebook service); (d) unauthorized intervention in any part of the entry process or the Contest; (e) printing, typographical, electronic or human errors which may occur in the offer or administration of the Contest or the processing of entries; or (f) any injury or damage to persons or property, including but not limited to participant’s computer, which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Contest (including, without limitation, from use of the Facebook service), or from viewing, playing or downloading any material from the Sponsor’s or Facebook’s website(s), regardless of whether the material was prepared by the Sponsor or a third party, and regardless of whether the material is connected to the Sponsor’s website by a hypertext link.


Participant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or the prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or provincial court located in British Columbia, Canada; participant submits to sole and exclusive personal jurisdiction to said courts in the Province of British Columbia for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Contest but in no event attorneys’ fees; and (c) under no circumstances will participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules of Contest, or the rights and obligations of participant or Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the Province of British Columbia, without giving effect to any choice of law or conflict of law rules of provisions (whether of the Province of British Columbia, Canada, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of British Columbia.
